Fiancée Visa
To obtain a fiancée visa, (K-1 visa) the petitioner must have no criminal convictions for violence, domestic violence or sex crimes. Obtaining a fiancée visa also takes roughly 6 months and may not be granted if the person requesting the visa has spent any time in the U.S. illegally. The couple must have met in person within the last two years in order for the fiancée visa application to be granted.
The Visa process for K-1 takes about six months. There are many documents that may be required to prove the fiancée/fiancé relationship. Our firm can help you gather the proper documents to support your case for a K-1 visa. The visa is granted for 90 days, the immigrant fiancée must enter the US, and must marry the resident petitioner within 90 days or the fiancée is required to return to their home country.
Spousal Visas
A spousal, or spouse, visa is also known as a K-3 visa. Obtaining this type of visa typically takes about 6 months. You can obtain work authorization as soon as you enter. You may enter the country as a spouse or a fiancée. If you enter as a fiancée, you must marry, then change status to obtain legal residence.
There are specific criteria that an applicant, and the spouse who is already in the United States, have to meet. One of these criteria is that the petitioner cannot have any history of criminal convictions for domestic violence, sex-related crimes or other violence. Also, if either party has any overstays or illegal entries into the United States, the K-3 visa will be denied.
The K-3 does not give legal residencey; you must file for an adjustment of status to obtain the legal residency.
