Affordable Southern California Representation in Removal of Conditional Residency Cases
Los Angeles and Bakersfield Immigration Attorneys
Conditional residency is a green card status granted to a foreign national who marries a U.S. citizen. If the couple has been married less than two years, upon entering the United States, the immigrant spouse is granted a "conditional residency" and at the end of the two year period, to maintain your legal residency, you must file to remove your "conditional residency" within the 90 days before the green card expires.
This must be done, or your legal residency will expire, and the immigrant spouse would be required to leave the United States. The USCIS wants to ensure your marriage is still valid and not a sham used to enter the United States. If the marriage ends before conditional residency is removed, you must take steps to protect your legal residency and your ability to remain in the United States.
At the office of Alfaro & Associates, we understand how emotional and difficult immigration matters can be, especially after the break-up of a marriage. We are an experienced immigration firm that can advise you with the complicated aspects of U.S. immigration laws.

If your marriage has ended, there are a number of reasons the USCIS may consider removing your conditional residency and allowing you to remain in the United States. You may be able to keep your legal residency if you can show one of the three requirements: 1) Hardship 2) A bona fide marriage 3) Abuse. If you claim hardship or abuse, you need to have records and documentation to prove your claims.
What if I do nothing?
If you do not file to remove the "conditional residency" you will lose your legal residency in the United States automatically, even if you are still married. Our firm represents clients with deportation matters, though we prefer to avoid deportation hearings by assisting you in obtaining the proper immigration status before deportation ever becomes an issue in your case.
